Do I need an attorney after a car accident?

Help, I've just been in an accident! Do I need an attorney?

This answer depends on a million different scenario, but there is NO law that requires you to get an attorney after an accident. However, there are numerous situations in which it would be strongly advisable to do so.

Here is what you should ask yourself before seeking an attorney:

1. How bad are your injuries?

Are your injuries severe or permeant? If your injuries are not permanent or severe, and you can return to normal life and work within a timely manner, you might be able to avoid hiring an attorney. In the event that your injuries are permanent or severe, you should strongly considering hiring an attorney. There is a lot more at stake for you and for the other parties insurance company, and that alone is enough to want to hire an attorney. Insurance companies can give you the runaround, or give you low offers, especially when they realize your true payout will be extremely significant.

2. How much insurance coverage is available to collect?

This may seem like a callous statement to make, but the COST vs. BENEFIT part of your case is helpful when deciding whether or not you want to hire an attorney.

3. Do I pay up front for an attorney?

Depending on the state you live in, do you owe money to an attorney up front or do they only collect fee's once you've received and won a payout. In Texas, you don't owe anything up front, you only pay your fee's to the attorney once your case is won (if it is won). This can play a large roll in if you decide to pursue a case or not. Not owing anything immediately can weigh heavily on your decision.
